It is one of the most common — and most consequential — questions about Spain’s Non-Lucrative Visa (NLV): can I apply from inside Spain, while I’m here as a tourist? The honest answer catches a lot of people out. For the NLV, you generally cannot apply from within Spain. It is a consular visa, and that shapes how you have to plan your move.

Where the NLV must be applied for

The Non-Lucrative Visa is applied for at the Spanish consulate that covers your country of legal residence — not at an immigration office inside Spain. You must lodge the application in person (or as the consulate directs) before you move, and you must be legally resident in that consulate’s jurisdiction when you do so. In practice that means a British citizen applies at a Spanish consulate in the UK, an American at a Spanish consulate in the US, and so on.

This is different from some other Spanish residence routes, which can be initiated or modified from within Spain. The NLV is deliberately a pre-arrival visa: the idea is that you arrive already authorised to reside.

Why you can’t convert from tourist status

Entering Spain as a tourist (the 90-days-in-180 Schengen allowance) does not give you a base from which to switch into the NLV. There is no “tourist-to-NLV” conversion at a Spanish police station. If you are already in Spain on a tourist stamp and decide you want the NLV, the standard path is to return to your home country and apply through the consulate there.

So while the visa is obtained abroad, the residence card that follows it is completed inside Spain. That second stage is the only part of the initial process that happens on Spanish soil.

Plan around the consular step

Because everything hinges on the consulate, timing matters. Appointment availability varies, document legalisation takes time, and some certificates (like criminal-record checks and medicals) have short validity windows, so they must be obtained in the right order. Building the file in the wrong sequence is one of the most common avoidable causes of delay.
