Do I stop paying South African tax when I move to Spain?
Once you cease SARS tax residency through the ordinarily resident and physical presence analyses, South African worldwide taxation ends. SA-source income (SA rental, SA dividends, SA employment, SA pensions) remains taxable in SA, subject to treaty reductions. Confirm cessation via the tax return disclosure and retain evidence of ties severed.
What is the SARS emigration deemed disposal?
When SARS tax residency ends, most worldwide assets are deemed disposed at market value, triggering CGT. Exclusions: SA immovable property, SA retirement fund interests in accumulation, certain specific assets. The deemed disposal can be the biggest single tax event of the move. Pre-emigration planning (realising losses, timing gains) materially reduces it.
What happens to my RA and pension funds?
Retirement Annuities (RAs) and pension funds in accumulation aren't deemed disposed. Post-2021 rules require a three-year wait after cessation of residency before early encashment is permitted (previously three months). Once drawn, SARS applies non-resident withholding; Spain taxes the pension income with treaty credit for SA withholding.
Can I keep a Pty Ltd while living in Spain?
Same POEM issue as other jurisdictions. Pty Ltd run from Spain becomes Spanish tax-resident in addition to SA. Treaty tiebreaker applies but administrative burden is high. Solutions: appoint SA-resident co-director and document SA meetings, or restructure to Spanish SL.
How does the SA-Spain treaty help?

Do I need to file Modelo 720?
Yes. Spanish tax residents declare foreign assets above €50,000 per category. SA bank accounts, RAs, unit trusts, SA property, listed SA shares all count. Filing is annual; updates required only if balance increases by more than €20,000 per category.
Does Beckham Law apply to South Africans?
Yes, subject to the standard Beckham tests (not Spanish-resident in the prior five years, move triggered by employment or director role). Flat 24% on Spanish-source employment income for six years; non-Spanish income exempt. For South Africans with some continuing SA-source passive income, the non-Spanish exemption is genuinely valuable.
What about South African exchange control?
South African exchange control is administered by SARB (Reserve Bank). Emigrants historically needed to formally emigrate through SARB; since 2021 the process has aligned with tax residency cessation. Remaining SA assets (accounts, property) can be retained; moving funds out of SA is subject to annual foreign investment allowance (currently R11M per year).
Can I transfer my SA pension to Spain?
