Selling property

For resident and non-resident sellers: the 3% non-resident retention, capital gains tax, plusvalía, community certificate, mortgage cancellation and notary completion — remotely under Power of Attorney where needed.

New build & off-plan

We review the developer contract, payment schedule, bank guarantees (Law 38/1999), building and first-occupation licences, snagging and the IVA + AJD position before any money changes hands.

Costa del Sol property tax

The Costa del Sol is in Andalucía, which sets its own transfer-tax rate:

Resale transfer tax (ITP)

Andalucían ITP at 7% of the declared price on resale property.

New-build tax

New build is taxed instead at 10% IVA + AJD 1.2% — not ITP.

Non-resident tax

Owners file annual Modelo 210, plus quarterly returns on rental income.

Wealth & high-value

High-value villa ownership can engage wealth/solidarity-tax planning — we advise up front.

Do I need a lawyer to buy on the Costa del Sol?

Practically yes. The notary does not act for you or carry out buyer-side due diligence. An independent lawyer checks the title, debts, licences, community position and tax before you commit.

What tax do I pay buying on the Costa del Sol?

The Costa del Sol is in Andalucía, so resale property is taxed at the Andalucían ITP rate of 7%. New build attracts IVA 10% + AJD 1.2% instead. We set out the full figure in writing before you commit.

Can foreigners buy on the Costa del Sol?

Yes. Foreigners can buy property in Spain. You need an NIE, a tax setup and usually a Spanish bank account. There is no restriction on foreign ownership.

Can I buy remotely?

Yes. We routinely complete purchases using a bilingual notarised Power of Attorney, so you do not need to travel to Spain to sign.

Can I rent out my property?

Often yes. Short-let requires Andalucían tourist registration (vivienda con fines turísticos, VFT), and the community statutes must permit it. We confirm both before you buy.
