South Africans don't fit the "standard English-speaking" DNV template — your file has specific hazards

Most DNV guidance aimed at the English-speaking market is written for American or British applicants. That works until it doesn't. South Africans face a very specific mix of issues that don't show up on US or UK files. DHA issues both abridged and unabridged certificates — only the unabridged version is accepted. DIRCO handles apostille for most public documents, but certain documents still need High Court legalisation before they can be apostilled. The SAPS Criminal Record Centre can take anywhere from a fortnight to several months to issue a police clearance. SARS operates two residency tests — the ordinarily-resident test (common-law) and the physical-presence test (statutory) — and leaving the country alone doesn't break either one. The "financial emigration" process that expats used to rely on was abolished in March 2021 and replaced with the SARS Approval for International Transfer (AIT) through the Tax Compliance Status system. Retirement annuity funds have a three-year waiting period before you can withdraw after ceasing SARS tax residency. And rand-denominated income has to be converted and presented to the UGE in a way that reads cleanly at the SMI threshold.

Key 2026 Update for South African Applicants

South Africa has been a signatory to the Hague Apostille Convention since 1995 — so DIRCO-apostilled public documents are accepted directly in Spain without consular legalisation. The important 2026 point is different: the SAPS Criminal Record Centre remains a bottleneck, and applicants who assume they can process the clearance in two or three weeks often find themselves waiting two or three months. Critical for South Africans: SARS Residency & the AIT Process

SARS applies two residency tests — the ordinarily-resident test (common-law) and the 91/915-day physical-presence test. Most South Africans who move without formally ceasing residency remain SARS tax-resident even while physically abroad, which creates dual residency with Spain. What you need to earn — in South African rand

The DNV income threshold is set at 200% of the Spanish SMI (minimum wage). The Spanish figures don't change based on where you live. Below are 2026 thresholds converted at approximate exchange rates (ZAR/EUR around 20). Rand volatility matters — we evidence income in both the original ZAR and a converted EUR figure, and we use conservative conversion rates to avoid a file being rejected on a month when the rand weakened.

Tax Planning For South African DNV Applicants

SARS residency and Beckham Law — two conversations, not one

South African DNV clients almost always benefit from thinking about tax in two parallel tracks: first, ceasing SARS tax residency cleanly under the ordinarily-resident and physical-presence tests, and second, electing into the Beckham Law special tax regime in Spain. The two conversations aren't the same — one is handled by your SARS-registered tax practitioner in South Africa, the other by a Spanish asesor fiscal — but they have to be coordinated, because the dates, the evidence and the governance decisions overlap. What Platinum Legal Spain handles is the immigration file. What we don't handle is the SARS cessation or the Beckham filing itself — both sit outside our fixed-fee DNV scope. Beckham Law (Régimen de Impatriados) gives qualifying new Spanish tax residents a 24% flat tax on Spanish-source employment income up to €600,000 and excludes most foreign-source income from Spanish tax for up to six years. For South Africans it can be extremely valuable — but it has to be filed on Form 149 within six months of arrival, and filing sits outside our DNV scope.

Retirement Annuity Funds — A Note for South African Applicants

South African retirement annuity funds cannot be withdrawn in full until three years have passed from the date you cease SARS tax residency. That three-year clock is a structural reality of SA retirement planning for expats — not something we or your Spanish asesor fiscal can shorten. Applicants moving to Spain should plan their cash-flow around this. This is SARS-practitioner work and sits outside our immigration scope; we just flag it early so you aren't surprised 14 months after landing in Madrid.

Can I apply if I'm earning in rand?
Yes — but presentation matters. The SMI threshold is denominated in euros, and the rand is volatile, so we evidence rand-denominated income using a conservative ZAR/EUR conversion rate and include supporting evidence — IRP5, IT34, payslips, bank statements — so the Consulate can verify the figure independently. South Africans earning in foreign currency (GBP, USD, EUR) clear the threshold more comfortably, but rand-only applications absolutely work when structured correctly.
How long does the SAPS clearance actually take?
In practice, anywhere from a fortnight to several months. The SAPS Criminal Record Centre has been a chronic bottleneck for South African expats. Our intake process asks you to order the clearance on day one of your engagement rather than waiting until the rest of the file is ready. Expedited channels exist through some providers but are inconsistent — the safest planning assumption is 8–12 weeks.
What's the difference between an abridged and unabridged birth certificate?
Abridged certificates are the slim card-style certificates most South Africans were issued at birth — they show your name, date of birth and the registering district, but not parental details. Unabridged certificates (DHA Form BI-24 style) include parental details and are the only version Spanish consulates accept. If you only hold an abridged certificate, order the unabridged from DHA before you do anything else — it's typically a 4–8 week re-issue.
Does my document need DIRCO apostille or High Court legalisation?
Most public documents issued by DHA or SAPS are apostilled directly by DIRCO in Pretoria. A minority of documents — particularly sworn affidavits, notarial documents and some private documents — have to be authenticated by the High Court first before DIRCO will apostille them. We map each document to the correct route on intake so nothing gets returned half-way through the process.
Do I need to formally cease SARS residency before I apply?
Not before you apply — the SARS cessation is tax-practitioner work that runs in parallel with the immigration file, and it's handled by your SARS-registered tax practitioner rather than us. What matters is that the cessation is clean by the time you land in Spain, because that date fixes your Spanish tax residency picture and your potential Beckham Law election. On the immigration side we care about the DIRCO-apostilled SAPS clearance, unabridged birth certificate and your income trail — not your SARS position.
What happens to my retirement annuity fund?
Once you formally cease SARS tax residency, your retirement annuity fund is subject to a statutory three-year waiting period before you can withdraw in full. That's a structural rule of SA retirement planning for expats — not something we or your Spanish asesor fiscal can accelerate. Plan your cash-flow around it and coordinate with your SA tax practitioner. This sits outside our DNV scope.
Can I run my Pty Ltd or CC from Spain?
You can, but be deliberate about it. If the effective management of your Pty Ltd or CC moves to Spain — which it does, if you're the sole director running the company from Madrid — the company may be both a South African tax resident under SA rules and a Spanish tax resident under Spanish rules, which creates a dual-residency tie-breaker under the SA-Spain DTA. This is SA-tax work, not immigration work, but we'll flag it on intake and coordinate with your SA tax practitioner if useful.
Does Beckham Law work for South African applicants?
Frequently very well. Beckham gives you a 24% flat rate on Spanish-source employment income up to €600,000 and excludes most foreign-source income from Spanish tax for up to six years — attractive for South Africans with retained SA rental income, dividends or interest. The modelling question is how your overall SA-plus-Spanish position works under Beckham versus standard Spanish residency. Your Spanish asesor fiscal runs the numbers and files Form 149 within six months of arrival. The Beckham filing sits outside our DNV scope.
When can I apply for Spanish permanent residency — and eventually citizenship?
South African DNV holders qualify for Spanish permanent residency after five continuous years of legal residency. Spanish citizenship for South Africans is longer — the general rule is ten years of legal residency, with no reduced-term pathway for South Africans specifically. Spain generally doesn't accept dual nationality with South Africa, so South Africans taking Spanish citizenship typically have to formally notify the Department of Home Affairs before the acquisition to preserve their SA citizenship. It's a different conversation we have closer to year ten — not on the DNV application.
