Platinum Legal Spain Affiliate Program Terms of Service

Agreement

By signing up to be an Affiliate in the Platinum Legal Spain Affiliate Programme (“Programme”), you agree to be bound by the following Terms of Service (“Agreement”).

Platinum Legal Spain reserves the right to update, modify, or replace these Terms of Service at any time without prior notice. Any continued participation in the Programme following such changes shall constitute your acceptance of those changes.

Any breach of this Agreement may result in the suspension or termination of your affiliate account and the forfeiture of any outstanding or unpaid commissions.

Account Terms

You must be at least 18 years of age and legally capable of entering into a binding agreement to participate in the Programme. Affiliates may be based in any country, provided they comply with all applicable laws and regulations in their jurisdiction.

You agree to provide accurate and complete information when registering, including your full legal name and a valid email address. You are responsible for maintaining the confidentiality and security of your account credentials. Platinum Legal Spain shall not be liable for any loss or damage resulting from your failure to secure your account.

Each account is intended for use by a single individual or legal entity. The creation of multiple accounts or the use of automated methods to generate accounts is strictly prohibited.

You agree not to use the Programme for any unlawful or unauthorised purpose and to comply with all applicable laws, including but not limited to GDPR, Spanish data protection laws, and applicable electronic marketing regulations.

Affiliate Links and Tracking

Upon acceptance into the Programme, you will be assigned a unique affiliate link (“Affiliate Link”). You may use this link to promote Platinum Legal Spain services through your website, email communications, social media, or other marketing channels.

All commissions are tracked exclusively through these Affiliate Links. It is your responsibility to ensure that links are correctly implemented and used. Platinum Legal Spain shall not be responsible for any commissions lost due to incorrect link usage, failure in tracking, or technical errors outside of its control.

Affiliate Links must not be used in a misleading, deceptive, or fraudulent manner and must always direct users to appropriate and relevant pages.

Referral Fees, Commissions and Payment

A commission will be earned when a client clicks your Affiliate Link and completes a purchase of a Platinum Legal Spain service. Commissions are only payable on services that are fully completed and paid for. Platinum Legal Spain reserves the right to withhold, adjust, or cancel commissions in cases of refunds, cancellations, duplicate transactions, or suspected fraudulent activity.

All commissions must be tracked through the official affiliate system. Platinum Legal Spain will not be liable for commissions that cannot be verified through its tracking system.

Affiliate payments will only be issued once the total accumulated commission reaches a minimum threshold of €200. If this threshold is not reached within a period of six (6) months from the date of the first recorded commission, the accumulated balance will be reset to zero and will not be carried forward.

Once the €200 threshold has been reached, payments will be processed on a monthly basis using an agreed payment method.

Promotion and Conduct

Affiliates may promote Platinum Legal Spain through lawful marketing channels, including websites, blogs, email marketing, and social media platforms.

You must not misrepresent Platinum Legal Spain, its services, or your relationship with the company. You are not authorised to provide legal advice, act on behalf of Platinum Legal Spain, or present yourself as part of the firm.

Any misleading, aggressive, or deceptive marketing practices are strictly prohibited. This includes, but is not limited to, spam, unsolicited communications without consent, false or exaggerated claims, impersonation, or misuse of branding.

Platinum Legal Spain reserves the right to reject or revoke commissions generated through any marketing activity deemed inappropriate, non-compliant, or harmful to the brand.

Compliance with Laws

As a condition of participation in the Programme, you agree to comply with all applicable laws, regulations, and codes of practice, including those relating to advertising, marketing, and data protection.

You are solely responsible for ensuring that your promotional activities, including any collection or processing of personal data, comply fully with GDPR and all relevant Spanish and EU regulations.

Tax Responsibility

You acknowledge and agree that you are solely responsible for determining, reporting, and paying any taxes, duties, or other governmental charges that may arise from commissions earned through the Affiliate Programme.

Platinum Legal Spain shall have no responsibility or liability for your tax obligations in any jurisdiction. This includes, but is not limited to, income tax, corporation tax, VAT, or any equivalent taxes applicable in your country of residence or operation.

You are responsible for ensuring full compliance with all local tax laws and regulations applicable to you. Platinum Legal Spain does not provide tax advice to affiliates in relation to their earnings under this Programme and may request relevant tax information or documentation where required by law.

Customer Relationship

All clients referred through the Programme shall be considered customers of Platinum Legal Spain. As such, all policies, procedures, pricing, and service decisions relating to those clients shall be determined solely by Platinum Legal Spain.

Prices, services, and availability may change at any time without notice. Affiliates should not display fixed pricing unless expressly authorised.

Termination

This Agreement may be terminated by either party at any time, with or without cause. Platinum Legal Spain reserves the right to suspend or terminate any affiliate account immediately in cases of breach, misuse, or suspected fraudulent activity.

Upon termination, you must immediately cease use of all affiliate links and remove any references to Platinum Legal Spain from your platforms. Any unpaid commissions may be forfeited if they are found to be in breach of these Terms.

Relationship of Parties

Nothing in this Agreement shall create any partnership, joint venture, agency, or employment relationship between you and Platinum Legal Spain. You act solely as an independent affiliate.

You have no authority to make representations, commitments, or offers on behalf of Platinum Legal Spain.

Limitation of Liability

Platinum Legal Spain shall not be liable for any indirect, incidental, special, or consequential damages arising in connection with the Programme. Total liability shall be limited to the amount of commissions earned and payable to you.

Disclaimers

The Programme is provided on an “as is” basis without warranties of any kind, whether express or implied. Platinum Legal Spain does not guarantee uninterrupted operation, accuracy of tracking, or error-free performance and shall not be liable for any such issues.

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Spain. Any disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the Spanish courts.

Final Provisions

This Agreement constitutes the entire agreement between you and Platinum Legal Spain in relation to the Affiliate Programme and supersedes any prior agreements or understandings.

Failure by Platinum Legal Spain to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce such provision or any other provision at a later time.
